Why It Matters
A federal rule designed to help the FDA track contaminated food "from farm to fork" in hours rather than days is now caught in a tangle of budget cuts, staffing reductions, and Congressional funding restrictions, raising questions about whether the U.S. food safety system is moving forward or backward.
The FDA Food Traceability Rule, mandated under Section 204 of the Food Safety Modernization Act (FSMA), was built to close the gaps exposed by high-profile outbreaks tied to romaine lettuce, deli meats, and shell eggs. A new Congressional Research Service report examines where the rule stands now, and the picture is complicated.
The Big Picture
The rule requires companies that manufacture, process, pack, or hold foods on the FDA's Food Traceability List to maintain detailed records of key data elements at each critical tracking event in the supply chain, including harvesting, cooling, packing, shipping, receiving, and transforming. Those records must be available to the FDA within 24 hours upon request.
The foods covered include cheeses, eggs in shells, fresh fruits and vegetables, seafood, and ready-to-eat deli salads. These are products with a documented history of foodborne illness outbreaks. The goal of the food supply chain tracking requirements is to compress outbreak investigations from days or weeks into hours, enabling faster recalls and potentially fewer deaths.
The original compliance deadline was January 20, 2026. It was never met.
In March 2025, the FDA announced its intention to push that deadline back by 30 months. By August 2025, the agency had published a formal Notice of Proposed Rulemaking to extend the compliance date to July 20, 2028, citing the complexity of coordinating thousands of supply chain entities. The FDA acknowledged that even companies ready to comply were hampered by partners elsewhere in the chain who were not.
Congress then went further. The FY2026 Agriculture, Rural Development, FDA, and Related Agencies Appropriations Act included language directing that no appropriated funds may be used to administer or enforce the Food Traceability Rule before July 20, 2028. A continuing resolution passed earlier in the year included similar language and required the FDA to engage with stakeholders on implementation. The enforcement freeze is now written into law.
Political Stakes
For the Administration: The compliance extension and Congressional funding restrictions align with the Trump administration's broader deregulatory posture. White House budget draft documents proposed a 17 percent funding cut to the FDA in fiscal year 2026, reducing its budget to approximately $6.5 billion and potentially shifting routine food facility inspections to states. DOGE-driven staffing reductions at both the FDA and USDA have drawn concern from consumer and public health groups about the agency's capacity to conduct food safety oversight at all, let alone implement a technically complex food traceability framework.
For Republicans: The party's deregulatory instincts are largely in sync with the enforcement pause, and the appropriations language reflects that alignment. But the CRS report surfaces a tension that is harder to dismiss. Outbreaks linked to products already on the Food Traceability List have caused illnesses and deaths. If a major outbreak occurs before 2028 that faster traceability could have contained, the political calculus would shift quickly.
For Democrats: The CRS report offers a ready-made line of attack. FDA food safety regulations are being weakened, they will argue, at exactly the moment the agency is losing staff and resources. The combination of a delayed rule, a funding-restricted enforcement mechanism, and a budget-cut agency creates a vulnerability that opposition lawmakers are likely to press, particularly if a foodborne illness outbreak gains public attention.
For the Public: Foods already linked to outbreaks, including leafy greens, eggs in shells and deli products, remain on store shelves without the full traceability infrastructure the rule was designed to create. The CRS report does not assess the probability of an outbreak, but it makes clear that the tools to respond rapidly to one are not yet in place.
The Bottom Line
The CRS report identifies a set of unresolved questions that Congress will need to answer: whether the compliance deadline extension is appropriate, how to weigh industry burdens against public health imperatives, and whether FDA has the resources to implement the rule even if the 2028 deadline holds.
One signal worth watching: the Senate Agriculture Appropriations Committee directed that no funding may be used to delay the enforcement of the FDA's Food Safety Modernization Act beyond July 20, 2028, suggesting that at least some members of Congress intend to hold the line on the rule's ultimate implementation, even as near-term enforcement is frozen.
